This Privacy Policy describes how ESQs Law PLLC (“the firm,” “we,” “us”) collects, uses, and protects information about clients, prospective clients, and visitors to esqs-law.com, the firm's client portal, and the firm's telephone and text messaging services.
Information we collect
We collect information you provide directly to us, including:
- Contact information, such as your name, mailing address, email address, and telephone number, provided during intake, consultations, or through the website contact form.
- Information about your legal matter that you share with the firm in the course of seeking or receiving legal services.
- Records of calls and text messages exchanged with the firm's phone number, kept as part of the client file.
How we use information
We use the information we collect to provide legal services; to communicate with you about your matter, including appointment reminders, court date and deadline notices, and document updates; to respond to inquiries; and to meet our obligations under the law and the Utah Rules of Professional Conduct. Information relating to the representation of a client is held in confidence as required by Utah Rule of Professional Conduct 1.6.
Text messaging (SMS) privacy
Clients consent to receive case-related text messages from the firm verbally during intake calls or in-person meetings, and that consent is documented in the client's matter file. Message frequency varies with case activity. Message and data rates may apply.
We do not share, sell, rent, or provide your mobile phone number, SMS opt-in status, or messaging consent data to third parties or affiliates for marketing or promotional purposes. Mobile information is used only to communicate with you about your legal matter and the firm's services to you.
You can opt out of text messages at any time by replying STOP to any message from the firm. Reply HELP for help, or contact the firm using the information below. Opting out of text messages does not affect your representation; the firm will use another method to reach you.
How information is shared
We do not sell personal information. We disclose information only as needed to provide legal services (for example, filings with courts and service on other parties as part of a representation), with your consent, or as required by law or court order. Service providers that process data for the firm (such as telephone, e-signature, and website hosting providers) are used only to deliver the firm's services and are not permitted to use your information for their own marketing.
Security and retention
We use reasonable administrative and technical safeguards to protect the information we hold, and we retain client records as required by the Utah Rules of Professional Conduct and the firm's record retention practices.
